Maintenance of Old Parents is Legal Obligation and Moral & Social Duty of Children

An old and illiterate mother of two sons sought monthly maintenance amount through court. She had alleged in her petition that her two sons had dispossessed her from the ground floor of the house and also started harassing her after the death of their father nine years ago.

And the Metropolitan court ordered payment of Rs 1000/- each by the two sons to the mother.

Subsequently, both the sons filed a revision petition before the sessions court against and challenging the above order passed under ‘Section 125’ of the “Criminal Procedures Code”. It is notable that both the sons are earning above Rs one lakh per month.

The Delhi Session court has ruled that providing maintenance to old parents is not only a legal obligation of a person but also his moral and social duty.
